1. Acceptance of these terms

Welcome to Lyric Kapithaven (we, us, our, Platform). These Terms govern your (you, your, User) access to our website, apps, trading tools, and related services (Services). By using the Services you agree to these Terms and our Privacy Notice plus Cookie Notice. If you do not accept them, please discontinue use of the Services.

2. Eligibility, user accounts, and limits

You need to be 18 or older and legally able to enter into a contract. You confirm you are not located in any place where use is barred. We may decline service, carry out KYC verification, and pause accounts for risk, fraud, or policy violations. You are responsible for keeping your profile details accurate and your login credentials secure.

3. Services, third parties, and risk exposure

We may introduce or reference third-party platforms; unless we clearly say otherwise, we are not acting as your broker. Trading carries a significant risk of loss. Previous performance is not a promise of future outcomes. You alone are responsible for your decisions and any taxes owed.

4. Charges, permitted use, and intellectual property

Any fees will be displayed at the time of purchase. You must not abuse the Services, including by posting illegal content, using malware, scraping without permission, bypassing security, or reverse engineering except where the law allows it. All Platform content and trademarks remain ours or our licensors' property; you are granted a limited, revocable licence to use them as provided.

5. Warranty disclaimers and liability limits

To the fullest extent permitted by Canadian law, the Services are provided as is without warranties of any kind. We exclude liability for indirect or consequential losses and, where permitted, cap total liability at the greater of C$130 or amounts you paid us in the three months before the claim. Nothing excludes non-excludable consumer protections.

6. Indemnification, account suspension, and ending access

You agree to cover us for claims resulting from your use of the Services or violation of these Terms. We may suspend or end access for breach, risk, or legal reasons. Sections that continue to apply include liability limits, indemnity, and dispute terms.
